These Terms of Service ("Terms") govern your access to and use of the Kixlogic applicant tracking system, including the dashboard, careers page, API, and all related services (collectively, the "Service"), provided by Kixlogic, LLC.
By signing up for, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that entity.
1. The Service
Kixlogic provides a cloud-based applicant tracking system (ATS) that allows businesses ("Customers") to post job openings, collect and manage employment applications, track candidates through a hiring pipeline, and communicate with applicants. The Service is provided on a subscription basis and includes a recruiter dashboard, white-label careers page, AI-powered features on eligible plans, email workflows, and reporting tools.
2. Accounts and Registration
You must be at least 18 years old, provide accurate registration information, and maintain the security of your account credentials. Notify us immediately at support@kixlogic.com if you believe your account has been compromised.
3. Subscription Plans and Billing
Kixlogic offers tiered subscription plans (Starter, Growth, Professional, and Enterprise) on a monthly basis. Current pricing is at kixlogic.com/pricing.
Free Trial: Growth and Professional plans include a 14-day free trial. A valid credit card is required. You will not be charged until the trial ends.
Billing: Subscriptions automatically renew monthly. Fees are in U.S. dollars.
Cancellation: Cancel anytime through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.
Payments are processed by Stripe. By providing payment information, you agree to Stripe's Terms of Service.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You agree not to discriminate unlawfully against applicants, send spam, attempt unauthorized access, transmit malware, reverse engineer the Service, or resell access without written consent.
5. Employment Law Compliance
You are solely responsible for ensuring your use of the Service complies with all applicable employment laws. Kixlogic provides EEO collection tools as a technical feature only — not legal advice.
6. Data and Privacy
Our collection and use of personal information is described in our Privacy Policy. You retain ownership of Customer Data you submit. You are the data controller for applicant information collected through your careers page.
Upon account cancellation, data is retained for 90 days then permanently deleted unless earlier deletion is requested.
7. AI Features
AI-powered tools including resume scoring, salary intelligence, and job description generation are available on eligible plans. AI outputs are informational only and should not be the sole basis for hiring decisions. You remain solely responsible for all hiring decisions.
8. Intellectual Property
The Service and all Kixlogic-created content are owned by Kixlogic and protected by applicable intellectual property laws. These Terms grant only a limited license to use the Service as described.
9. Third-Party Services
The Service integrates with third-party services including Stripe (payments), Cloudflare (hosting), Supabase (database), and Anthropic (AI). Your use of integrated services is subject to their respective terms.
10. Service Availability
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
11. Limitation of Liability
To the maximum extent permitted by law, Kixlogic's total liability for any claims arising from the Service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
12. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.
